New agency regulations

 

Terms of business

 

For employment agencies and employment businesses (and particularly those in the IT sector), Egos offers a legal service, supported by a thorough understanding of the way in which the industry actually works in practice, and of the needs, requirements, and legal issues affecting all those working in it.

 

Our starting points for terms of business have been fundamentally rewritten to take account of all relevant developments, including

 - and doing so with a minimum of adverse effect to an agency's commercial position.

 

In the 10 years that has passed since we began focusing on this sector, we have seen and advised on a vast number of agency contracts, and have also advised in a large number of instances where something has gone wrong. It's probably true to say that at least 90% of the time, it's less likely that things would have gone wrong if the contractual documentation had been better drafted - and had been better understood at the time by all involved.

 

If you operate an employment agencies or employment businesses, we can help you to 'get it right'. The risks inherent in such business dealings can be significantly reduced with good documentation. Such documentation also has the advantage of being relatively easy to understand, and as such can in itself be an effective sales tool to complement the skills of your own staff.

 

We use a common schedule for both client and consultant, whilst allowing for the rates on each side to be kept confidential;  this is intended to significantly reduce administration, and (perhaps more importantly) reduce the risks of error.

 

Commitments are passed on to the consultant wherever practicable, and to help minimize risk the client is given a direct line of legal approach to the consultant.  The terms are designed to be consistent with an ‘outside the regulations’ position, where justified by the facts, whilst fully covering the position for engagements within the regulations.

 

Naturally, any terms we produce for you will be tailored to your own specific requirements and to your own way of doing business - the things that help to make your own business unique .

We will agree a fee in advance (obviously a one-off fee, not an additional charge each time you use the documents - and with no ongoing commitment). All documents will be prepared with proper regard for the real world situations they will govern - and will naturally take into account your own commercial interests.

Confidentiality applies, of course. We will acknowledge your right of confidentiality in connection with anything you disclose to us, and we will not disclose it to anyone else save to such extent as may be authorized by you or required by law.
