Case 0209-003 Background: My Contractor client had taken a contract for 10 weeks with a difficult client, who (despite engaging my client through an agency as an expert for the benefit of his expert advice) in fact became very awkward about actually listening to that advice. This got my client down to the point where he found himself unable to go in to work one week, and the agency, after trying to get hold of him several times to ascertain the position, then terminated the contract on the grounds of his breach in that he had not provided the contracted services. The agency then placed another contractor in the position, at a reduced charge to the client and at a lower rate. My client invoiced the agency for the previous month; the agency asked for a revised invoice to pay then the commission they would have earned during the week my client did not work before termination; he provided that; then they said they also wanted him to make up the reduced commission they would have earned during the remainder of the contract, and asked for a further revised invoice. Case 0209-001 Background: A long-established Agency client of mine had engaged a foreign national from his employer (who held the relevant work permit), and had hired him on to a Client. The employer, who had already made very substantial amounts of money on the margin between what my Agency client was paying them and what they were paying the individual for some years) withheld the individual’s last months salary and holiday pay, without any proper cause. My Agency client believed this withholding to be wholly wrong and morally indefensible. More…
Case 0209-002 Background: An existing Consultant client of mine was brought in by his own client (a public service / utility company) to try and get a project for supply and installation of an EPOS system which was being acquired from a third party software house back on track – the suppliers were making a bit of a mess of things, the software they had supplied wasn’t working, the suppliers seemed to be losing interest and trying to focus more on gaining tomorrow’s orders from elsewhere, rather than fulfilling yesterday’s orders - and the utility company had deadlines which it seems clear would not be met.
